Obama Signs Border Security Appropriations Act Increasing Filing Fees for Some H-1B and L-1 Employers

On Friday August 13, President Obama signed into law the Border Security Emergency Supplemental Appropriations Act of 2010 (H.R. 6080). In addition to increasing funding for border security infrastructure and government agencies involved in border protection, the Act significantly increases filing fees for H-1B "specialty occupation" and L-1 "multinational transferee" petitions filed by some employers. Companies with 50 or more employees that employ more than 50% of the employees in H-1B or L-1 status will have to pay an increased "antifraud" filing fee of $2,250 for new L-1 petitions, and $2,000 for new H-1B petitions. The antifraud filing fee for all other employers will remain $500.The increased fees, which are effective immediately, are set to end on September 30, 2014.

What this Means to You

The provision of the Act increasing antifraud fees is targeted at certain employers that rely heavily on H-1B and L-1 classifications. It does not affect that vast majority of US employers that employ less than 50% of employees in H-1B or L-1 status.
