DOS Issues July 2008 Visa Bulletin: EB-3 Unavailable in All Categories
The Department of State ("DOS") issued its July 2008 Visa Bulletin, announcing the unavailability of visa numbers in all employment third preference ("EB-3") categories. Cut-off dates for all other categories remain the same as the June 2008 Visa Bulletin. The EB-3 category is expected to reach its annual numerical limit by the end of June due to the demand for visa numbers, primarily by the United States Citizenship and Immigration Services ("USCIS") as it continues to approve adjustment of status cases. As a result, the category will be "unavailable" beginning in July, and the DOS expects that it will remain "unavailable" for the remainder of fiscal year 2008, which ends on September 30, 2008. The DOS is unsure whether the cut-off dates for EB-2 China and EB-2 India will move forward. Changes in the cut-dates for these two categories will depend upon the overall EB-2 demand for visa numbers in the upcoming months. Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved, for an adjustment of status application in the month of July 2008.
