Department of State Makes Changes to J-1 Exchange Visitor Program The
Department of State ("DOS") has significantly modified the J-1 Exchange
Visitor Program. The agency's interim final rule eliminates the
distinction between "non-specialty occupations" and "specialty
occupations," establishes a new internship program, and modifies the
selection criteria for participation in a training program. The new regulation also
requires J-1 sponsors to screen, vet, and enter into written agreements
with third parties who assist them in recruiting, selecting, screening,
orienting, placing, training or evaluating foreign nationals who
participate in training and internship programs. Sponsors must fully complete and
secure signatures on a new Form DS-7002, Training/Internship Placement
Plan (T/IPP), for each trainee and intern prior to issuing a Form DS-2019.
The regulatory change is
effective on July 19, 2007, and applies to all Forms DS-2019 issued on or
after that date. .
"Trainees" Basic
Eligibility Requirements: Under the new rule, in order to
qualify for admission as a trainee, the foreign national should have
either 1) a degree or professional certificate from a post-secondary
academic institution outside the U.S. and at least one year of prior
related work experience in his or her occupational field; OR 2) five years
of work experience outside the U.S. in his or her occupational field.
The
trainee must also demonstrate sufficient fluency in English to function on
a day-to-day basis in the training environment. Trainees' English language
skills must be verified by a recognized English language test, by signed
documentation from an academic institution or English language school, or
through a documented interview conducted by program sponsors or a third
party in person, by videoconferencing, or by web camera.
Training/Internship
Placement Plan ("T/IPP"): Effective
July 19, 2007, all training plans for both trainees and interns must state
the specific goals and objectives of the training and internship program;
detail the knowledge, skills or techniques to be imparted to the trainee
or intern; and describe the methods of performance evaluation and the
supervision for each phase or component. For trainees, the plan must also
describe the methodology of training and provide a chronology or syllabus.
The T/IPP must be
completed by the J-1 Sponsor on Form DS-7002 with signatures prior to issuing a Form DS-2019.
Maximum
Duration of Training Program: Training
programs will have a maximum duration of 18 months. However, training programs in the
field of agriculture and in the "Hospitality and Tourism" occupational
category will be limited to 12 months unless the training is for
management in these areas in which case the program may last 18 months.

"Interns" Basic
Eligibility:
Foreign nationals may qualify
for admission as interns if 1) they are currently enrolled in and pursuing
studies at a degree or certificate-granting post-secondary academic
institution OR 2) graduated from such an institution no more than 12
months prior to their exchange visitor program start date to participate
in an internship program. Training/Internship
Placement Plan ("T/IPP"): As
with trainees, the training program for interns must state the specific
goals and objectives of the training and internship program; detail the
knowledge, skills or techniques to be imparted to the trainee or intern;
and describe the methods of performance evaluation and the supervision for
each phase or component. For interns, a description of the intern's
specific tasks and activities, the role of the intern in the organization,
and the department(s) in which the intern will work must be provided.
The T/IPP must also be
completed on Form DS-7002 with signatures prior to issuing a Form DS-2019.
Those
who have completed their internship program may participate in a training
program only after a two-year period of residency outside the
.
New
Obligations for Program Sponsors In
addition to the new requirements for the T/IPP described above, sponsors
must now enter into written agreements with third parties, outlining the
full relationship between the parties on all matters involving the
Exchange Visitor Program. Third parties must provide a Dun &
Bradstreet identification number. Sponsors must also screen and vet all
third parties. Organizations
that host trainees or trainees on behalf of sponsors must be prepared to
show that they are legitimate entities are appropriately registered or
licensed to conduct their activities in their jurisdiction, and have the
resources to provide the appropriate training or internship program.
How
this Affects You The
DOS made revisions to the J-1 program out of concern that the nonimmigrant
category was being used in lieu of the H-1B visa or as a "stepping stone"
for another longer-term nonimmigrant or immigrant classification that may
have been unavailable at the time of the visa application. At the same time, the
DOS does recognize that work is an essential component of on-the-job
training, and that in many respects there are no conceptual or legal
distinctions
between an employee and a trainee.
