H-1B Filing Season for Fiscal Year 2007 Begins on April 1st

Employers may file new H-1B petitions subject to the 2007 annual numerical limitation (“the Cap”) beginning on April 1, 2006 for an October 1, 2006 start date. Given the limited number and increasing demand for H-1B petitions, we recommend filing petitions for persons who are subject to the Cap on April 1, 2006, as it is possible that the availability of such petitions will run out shortly after this date. The following are examples of persons for whom H-1B petitions may need to be filed:

  • Persons in F-1 status currently working for the employer pursuant to Optional Practical Training (OPT);
  • Students in F-1 status whom the employer seeks to hire upon graduation this spring;
  • Persons in J-1 status whom the employer wishes to hire;
  • Persons working at the employer in L-1 status who are approaching the fifth year in L-1 status;
  • Persons working at the company in TN status for whom the employer wishes to pursue green card sponsorship; and,
  • Persons working outside the United States whom the company wishes to employ in the United States during the 2007 fiscal year (which runs October 1, 2006 to September 30, 2007).
