DOS Releases August 2010 Visa Bulletin: Priority Date for EB-3 Worldwide (Except India, China and Mexico) Advances

The Department of State (DOS) released the August 2010 Visa Bulletin, indicating a ten-month advancement in the cut-off date for the employment-based third preference (EB-3) category worldwide, except for India, China and Mexico. There was also a slight advancement in the cut-off dates in the EB-2 and EB-3 categories for individuals born in India and China, while the EB-3 category for individuals born in Mexico remains unavailable.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved for, an adjustment of status application in the month of August 2010. They may also be approved for an immigrant visa abroad:

March 1, 2006 (forward movement of three months)

EB-2 India

March 1, 2006 (forward movement of five months)

EB-3 Worldwide (excluding China, India, Mexico and the Philippines):

June 1, 2004 (forward movement of ten months)

EB-3 China:

September 22, 2003 (forward movement of one month)

EB-3 India:

January 1, 2002 (forward movement of two months)

EB-3 Mexico:

Unavailable

EB-3 Philippines:

June 1, 2004 (forward movement of ten months)
