DOS Announces Unavailability of Immigrant Visas for EB-3 Mexico; Priority Dates Advance for Other EB-3 Categories

The Department of State (DOS) released the May 2010 Visa Bulletin, announcing the unavailability of immigrant visas in the employment-based third preference (EB-3) category for individuals born in Mexico. Visas will remain unavailable in this category until the start of the new fiscal year on October 1, 2010. The priority dates for the employment-based second preference (EB-2) category for individuals born in China and for the employment-based third preference (EB-3) category for individuals born in India advanced slightly, while the priority date for EB-2 India remained unchanged from the April 2010 visa bulletin.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved for, an adjustment of status application in the month of May 2010. They may also be approved for an immigrant visa abroad:
