April 2010 Visa Bulletin Released: Slight Advancement of Cut-Off Dates for EB-2 China and EB-3 for Most Countries

The Department of State (DOS) released the April 2010 Visa Bulletin, revealing only slight advancements in the employment-based second preference (EB-2) category for individuals born in China and advancements in the employment-based third preference (EB-3) category for persons born in most countries. The EB-3 cut-off date for individuals born in Mexico and EB-2 cut-off date for individuals born in India remain unchanged from the March 2010 visa bulletin.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved for, an adjustment of status application in the month of April 2010. They may also be approved for an immigrant visa abroad:

EB-1 Worldwide:

EB-2 Worldwide (excluding China and India):

EB-2 China

August 22, 2005 (forward movement of 6 weeks)

EB-2 India

February 1, 2005 (no change)

EB-3 Worldwide (excluding China, India, Mexico and the Philippines):

February 1, 2003 (forward movement of 6 weeks)

EB-3 China:

February 1, 2003 (forward movement of 6 weeks)

EB-3 India:

September 8, 2001 (forward movement of approximately 2 months)

EB-3 Mexico:

July 1, 2002 (no change)

EB-3 Philippines:

February 1, 2003 (forward movement of 6 weeks)
