DOS Releases March 2010 Visa Bulletin: Advancement of Cut-Off Dates for EB-2 and EB-3 Categories

The Department of State (DOS) released the March 2010 Visa Bulletin, revealing slight advancements in the employment-based second and third preference categories. The cut-off dates for the third preference (EB-3) category for individuals born in India advanced 10 days, while the EB-3 category for individuals born in China, the Philippines and all other countries advanced more significantly by approximately 4 months. However, the cut-off date for EB-3 individuals born in Mexico, remains unchanged from the February 2010 visa bulletin.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved for, an adjustment of status application in the month of March 2010. They may also be approved for an immigrant visa abroad:

EB-1 Worldwide:

EB-2 Worldwide (excluding China and India):

Current

EB-2 China

July 8, 2005 (forward movement of 6 weeks)

EB-2 India

February 1, 2005 forward movement of 10 days)

EB-3 Worldwide (excluding China, India, Mexico and the Philippines):

December 15, 2002 (forward movement of approximately 3 months)

EB-3 China:

December 15, 2002 (forward movement of approximately 3 months)

EB-3 India:

July 1, 2001 (forward movement of 10 days)

EB-3 Mexico:

July 1, 2002 (no change)

EB-3 Philippines:

December 15, 2002 (forward movement of approximately 3 months)
