DOS Releases February 2010 Visa Bulletin: Slight Advancement for EB-2 China and Most EB-3 Categories

The Department of State (DOS) issued the February 2010 Visa Bulletin, indicating a forward movement of three weeks in the employment-based second preference category for individuals born in China. The cut-off dates for the third preference (EB-3) categories for individuals born in China, Philippines and worldwide also each advanced over one month. All other employment-based categories remained unchanged from the January 2010 visa bulletin.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved for, an adjustment of status application in the month of February 2010. They may also be approved for an immigrant visa abroad:

EB-1 Worldwide:

EB-2 Worldwide (excluding China and India):

Current

EB-2 China

May 22, 2005 (forward movement of 3 weeks)

EB-2 India

January 22, 2005 (no change)

EB-3 Worldwide (excluding China, India, Mexico and the Philippines):

September 22, 2002 (forward movement of 7 weeks)

EB-3 China:

September 22, 2002 (forward movement of 7 weeks)

EB-3 India:

June 22, 2001 (no change)

EB-3 Mexico:

July 1, 2002 (no change)

EB-3 Philippines:

September 22, 2002 (forward movement of 7 weeks)
