DOS Releases January 2010 Visa Bulletin: Visa Office Advises of Potential Unavailability for EB-2 India and China

The Department of State (DOS) Visa Office issued the January 2010 Visa Bulletin, indicating slight forward movement in the employment-based third preference (EB-3) category for all countries, and in the employment-based second preference (EB-2) category for persons born in China. The EB-2 cutoff date for persons born in India remains unchanged.

The January Visa Bulletin also projects that the EB-2 category for persons born in China and India may become "unavailable" in 2010 if high demand causes the annual limit to be reached. If so, it would be the first time since August 2007 that EB-2 has been unavailable for these countries.

Foreign nationals with priority dates earlier than the cut-off dates indicated below, or where noted as "current", may file, or be approved for, an adjustment of status application during the month of January 2010. They may also be approved for an immigrant visa abroad:

May 1, 2005 (forward movement of 1 month)

EB-2 India

January 22, 2005 (no change)

EB-3 Worldwide (excluding China, India, Mexico and the Philippines):

August 1, 2002 (forward movement of 2 months)

EB-3 China:

August 1, 2002 (forward movement of 2 months)

EB-3 India:

June 22, 2001 (forward movement of 1.5 months)

EB-3 Mexico:

July 1, 2002 (forward movement of 1 month)

EB-3 Philippines:

August 1, 2002 (forward movement of 2 months)
