DOS Releases the November 2009 Visa Bulletin: Little Forward Movement

The Department of State issued the November 2009 Visa Bulletin, indicating little forward movement in the employment-based third (EB-3) preference categories for individuals born in China, India or Mexico and slight forward movement in the employment-based second (EB-2) preference category for individuals born in China. The visa cut-off dates for all other employment-based preference categories remain unchanged from the month of October 2009.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved for, an adjustment of status application in the month of November 2009. They may also be approved for an immigrant visa abroad:

EB-1 Worldwide:

Current

EB-2 Worldwide (excluding China and India):

Current

EB-2 China

April 1, 2005 (forward movement of 10 days)

EB-2 India

January 22, 2005 (no change)

EB-3 Worldwide (excluding China, India, Mexico and the Philippines):

June 1, 2002 (no change)

EB-3 China:

June 1, 2002 (forward movement of approx. 3 months)

EB-3 India:

April 22, 2001 (forward movement of 7 days)

EB-3 Mexico:

June 1, 2002 (forward movement of 1 month)

EB-3 Philippines:

June 1, 2002 (no change)
