DOS Announces Cut-Off Dates for EB-3 Category in the October 2009 Visa Bulletin

On September 9, 2009, the Department of State issued the October 2009 Visa Bulletin. As of the start of the new fiscal year on October 1, 2009 (FY2010), the employment-based third preference category will be available for applicants with priority dates prior to the cut-off dates listed below. The Department of State also announced continued forward movement in the cut-off dates for the employment-based second preference (EB-2) category for applicants born in China or India.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved for, an adjustment of status application in the month of October 2009. They may also be approved for an immigrant visa abroad:

March 22, 2005 (forward movement of approx. 3 months)

EB-2 India

January 22, 2005 (forward movement of approx. 2 weeks)

April 15, 2001 (previously unavailable)

EB-3 Mexico:

May 1, 2002 (previously unavailable)

June 1, 2002 (previously unavailable)
