DOS Announces Continued Advancement in EB-2 China and India Cut-Off Dates in September 2009 Visa Bulletin

The Department of State issued the September 2009 Visa Bulletin last week. The bulletin announced continued forward movement of the immigrant visa cut-off dates for the employment-based second preference (EB-2) category for applicants born in China or India. The cut-off dates for these two categories will advance to January 8, 2005, a movement of approximately 15 months. The employment-based third preference (EB-3) category remains "unavailable" through the month of September 2009.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved for, an adjustment of status application in the month of September 2009. They may also be approved for an immigrant visa abroad:
