DOS Issues January 2009 Visa Bulletin: Little Forward Movement in Most Employment-Based Categories

The Department of State (DOS) issued its February 2009 Visa Bulletin, announcing slight forward movement in the cut-off dates for employment-based second (EB-2) China and India and employment-based third (EB-3) China and Mexico categories. The cut-off dates for the EB-3 "other workers" category retrogressed for China, India and Mexico applicants, but remained unchanged for all other countries.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved, for an adjustment of status application in the month of February 2009. They may also be approved for an immigrant visa abroad:

EB-1 Worldwide:   Current
EB-2 Worldwide (excluding China and India):   Current
EB-2 China:   January 1, 2005 (forward movement of 6 months)
EB-2 India:   January 1, 2004 (forward movement of 6 months)
EB-3 Worldwide (excluding China, India, Mexico and the Philippines):   May 1, 2005 (no change)
EB-3 China:   October 1, 2002 (forward movement of 4 months))
EB-3 India:   October 15, 2001 (no change)
EB-3 Mexico:   April 1, 2003 (forward movement of 5 months)
EB-3 Philippines:   May 1, 2005 (no change)
