DOS Issues January 2009 Visa Bulletin: Little Forward Movement in Most Employment-Based Categories

The Department of State (DOS) issued its January 2009 Visa Bulletin, announcing slight forward movement in the employment-based second (EB-2) and employment-based third (EB-3) categories for persons born in China, India, Mexico and the Philippines. The EB-2 and EB-3 cut off dates for persons from all other countries remain unchanged.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved, for an adjustment of status application in the month of January 2009. They may also be approved for an immigrant visa abroad:

EB-1 Worldwide:   Current
EB-2 Worldwide (excluding China and India):   Current
EB-2 China:   July 8, 2004 (forward movement of 5 weeks)
EB-2 India:   July 1, 2003 (forward movement of 1 month)
EB-3 Worldwide (excluding China, India, Mexico and the Philippines):   May 1, 2005 (no change)
EB-3 China:   June 1, 2002 (forward movement of 4 months)
EB-3 India:   October 15, 2001 (forward movement of 2 weeks)
EB-3 Mexico:   November 15, 2002 (forward movement of 2 months)
EB-3 Philippines:   May 1, 2005 (no change)
