DOS Issues August 2008 Visa Bulletin: Significant Forward Movement in EB-2 Immigrant Visa Cut-Off Dates

The Department of State ("DOS") issued its August 2008 Visa Bulletin, announcing forward movement of more than two years, from April 1, 2004 to June 1, 2006, in the employment-based second preference ("EB-2") categories for persons born in China and India. Cut-off dates in the employment-based third preference ("EB-3") categories remain unavailable, as the DOS had predicted in last month's (July 2008) visa bulletin.

Foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved, for an adjustment of status application in the month of August 2008. They may also be approved for an immigrant visa abroad:

EB-1 Worldwide:   Current
EB-2 Worldwide (excluding China and India):   Current
EB-2 China:   June 1, 2006 (forward movement of 26 months)
EB-2 India:   June 1, 2006, (forward movement of 26 months)
EB-3 Worldwide (excluding China, India, Mexico and the Philippines):   Unavailable
EB-3 China:   Unavailable
EB-3 India:   Unavailable
EB-3 Mexico:   Unavailable
EB-3 Philippines:   Unavailable
