DOS Issues June 2008 Visa Bulletin: Forward Movement in EB-2 Category for China and India

The Department of State ("DOS") issued the June 2008 Visa Bulletin, announcing forward movement in the employment second preference ("EB-2") category, but no change in the cut-off dates for all other employment-based visa categories. Cut-off dates for the EB-2 category for Indian and Chinese nationals advanced three months from January 1, 2004 to April 1, 2004.

Due to the adjudication of adjustment of status cases by the USCIS, the DOS announced that the employment third preference ("EB-3") category is close to reaching its annual numerical limit in June 2008. As a result, this category is likely to experience retrogressions or possibly visa unavailability beginning in July. The DOS has assured, however, that visas in the EB-3 category would again be available in October 2008, the first month of the new fiscal year.

Qualified foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved, for an adjustment of status application in the month of May 2008. They may also be approved for an immigrant visa abroad:
