DOS Issues May 2008 Visa Bulletin: Forward Movement in All Employment-Based Categories
In its May 2008 visa bulletin, the DOS has announced forward movement in the cut-off dates for all employment-based categories. Visas in the EB-2 category for Indian nationals advanced one month from December 1, 2003 to January 1, 2004. The EB-3 category for nationals of the Philippines also experienced rapid forward movement, with the cut-off date advancing eleven months. The DOS stated that it has advanced many of the employment-based cut off dates for May 2008 more rapidly than ordinarily expected. This is due to USCIS caseload projections and its overall goal to maximize the usage of visa numbers in each category. If USCIS projections regarding the demand of visa numbers proves to be incorrect, and the demand is higher than expected, it may be necessary to adjust the cut-off dates during the final quarter of FY2008. Qualified foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file, or be approved, for an adjustment of status application in the month of May 2008.
