DOS Issues April 2008 Visa Bulletin: EB-2 India Visa Numbers Become Available

The Department of State ("DOS") issued its April 2008 Visa Bulletin. Visas in the EB-2 category for Indian nationals have become available. Based on the current level of demand received, primarily at the USCIS Service Centers, the DOS has indicated that the EB-2 India category is again available in the month of April 2008. Applicants in this category with priority dates prior to December 1, 2003 may file adjustment of status applications in April 2008. The DOS will continue to monitor the numbers used in this category throughout this calendar quarter, and if demand in this category increases, the cut-off date may regress or visa numbers may again be unavailable for upcoming months.

Other visa categories, except for EB-2 China, experienced some forward movement. As was expected by the DOS at the publication of the March 2008 Visa Bulletin, the significant forward movement in most employment-based categories in March 2008 has resulted in increased demand in these categories and less substantial forward movement for the month of April 2008.

Qualified foreign nationals with priority dates earlier than the cut-off dates below, or where noted as "current", may file for an adjustment of status application in the month of April 2008. They may also be approved for an immigrant visa abroad:

EB-3 Worldwide (excluding China, India, Mexico and the Philippines):

February 8, 2003 (forward movement of 2 months)

EB-3 India:

October 1, 2001 (forward movement of 2 months)

EB-3 Mexico:

October 1, 2001 (forward movement of 5 months)

EB-3 Philippines:

July 1, 2005 (forward movement of 6 months)
