DOS Issues January 2008 Visa Bulletin: EB-2 India Retrogresses

The Department of State (“DOS”) has issued its January 2008 Visa Bulletin. Waiting periods for persons born in India in the EB-2 category will increase significantly due to continued high demand. In fact, waiting periods for the India EB-2 category will exceed those of the India EB-3 category.

Those with priority dates earlier than the cut-off dates below, or where noted as “current”, may file for an adjustment of status application in the month of January 2008. They may also be approved for an immigrant visa abroad:

EB-1 Worldwide:

Current

EB-2 Worldwide (excluding China and India):

Current

EB-2 China

January 1, 2003 (no movement)

EB-2 India

January 1, 2000 (retrogression of two years)

EB-3 Worldwide (excluding China, India, Mexico and the Philippines):

October 15, 2002 (forward movement of six weeks)

EB-3 China:

November 1, 2001 (forward movement of two weeks)

EB-3 India:

May 1, 2001 (no movement)

EB-3 Mexico:

April 22, 2001 (no movement)

EB-3 Philippines:

October 15, 2002 (forward movement of six weeks)

How This Affects You

The DOS reports in its January 2008 Visa Bulletin that it is likely the annual limit for EB-2 India will be reached within the next few months. If the annual allotment is exhausted, immigrant visas will be unavailable for those born in India and eligible for EB-2 classification for the remainder of the fiscal year, which ends on September 30, 2008.
