Employment-Based Visa Backlog Continues to Improve

The Department of State’s March Visa Bulletin which was released yesterday showed significant improvement of the backlog for employment-based immigrant visas for persons born in India and China. Most notably, the Employment-Based Third Preference (EB-3) for persons born in India has improved by a year since the last Visa Bulletin was released a month ago. On March first, the cut-off date for EB-3 India will be set at January 1, 2001. The Employment-Based Second Preference (EB-2) has improved by five months for India and three months for China, with cut-off dates to be set at January 1, 2002 and July 1, 2002, respectively. The Employment-Based First Preference (EB-1) has also shown considerable improvement, moving forward five months for India, and six months for China. The EB-1 cut off dates will be July 1, 2004 for India, and July 1, 2003 for China. Unfortunately, the EB-3 backlog for persons from all other countries has moved little from last month; the new cut-off will be May 1, 2001, an improvement of only 14 days from last month.

Despite the recent improvement in the backlog, the Department of State warns that these advances “might not continue indefinitely,” and that some classifications may retrogress even further.
