Businesses in Contract with Federal Government Must Use E-Verify

President Bush has signed Executive Order 12989, which requires businesses entering into a contract with an agency or department of the federal government to electronically verify the employment eligibility of their employees. Government contractors will have to use an electronic program designated by the Department of Homeland Security ("DHS"), such as E-Verify, to confirm the employment authorization of the following:

  • All individuals hired during the contract term for work conducted within the United States; and
  • All employees assigned to work in the United States under the federal contract.

E-Verify is an electronic system administered by the United State Citizenship & Immigration Services ("USCIS") and the Social Security Administration ("SSA") for the verification of employment authorization. E-Verify provides access to federal databases to assist employers determine employment eligibility of new hires and the validity of their Social Security numbers.

How This Affects You:
It is unclear at this point how this Executive Order will affect employers. It does not state when this electronic verification requirement will take effect, or provide specifics of how an employer may comply.
