Revised Visa Bulletin: Employment-Based Adjustment of Status Applications to be Accepted through August 17, 2007
Today, the Department of State (“DOS”) issued its August 2007 Visa Bulletin. Although employment-based preference categories remain unavailable for the remainder of the fiscal year, the Bulletin states that as a result of discussion with the United States Citizenship & Immigration Services (“USCIS”), the original July Visa Bulletin issued on June 12, 2007 “should be relied upon as the current July Visa Bulletin” for purposes of determining employment visa number availability during the month of July, and that the revised July visa bulletin issued by the DOS on July 2, 2007 has been withdrawn.
In a related press release, the USCIS announced today that it will accept employment-based adjustment of status applications for those whose priority dates were current under the original July Visa Bulletin issued on June 12, 2007. The agency will accept such applications filed no later than August 17, 2007. A copy of this press release is available on our website at: www.mgplc.com/bizimm_alert/USCISVisaUpdateJuly2007.pdf.
· How This Affects You
All employment-based preference categories, except “other workers” are current through August 17, 2007. Applications for adjustment of status that have been received by USCIS in the month of July will be accepted for processing and receipted.
