Visa Bulletin: EB-1, EB-2 and EB-3 Priority Dates will be Current for All
Countries The United States Department of State ("DOS") has
released its July 2007 Visa Bulletin. The Visa
Bulletin sets out per country priority date cut-offs that regulate the flow of Adjustment of
Status ("AOS") and consular immigrant visa applications. How This Affects You After over eighteen
(18) months of significantly retrogressed priority date cut-off dates, priority dates for the
EB-1, EB-2 and EB-3 preference categories are now current for all countries. On July 1, 2007,
foreign nationals from any country in the EB-1, EB-2, and EB-3 preference categories may file
an AOS application, or obtain approval of an immigrant visa application at an American embassy
or consulate abroad. A
continued forward trend should not be assumed, however, as priority date
cut-offs are assessed on a monthly basis by the DOS based on
anticipated demand. Cut-off dates can move forward, backward, or remain static.
Employers and employees should take account of
any immigrant visa backlogs in their long-term planning.
